Harley-Davidson is trying to sue the pants off an online T-shirt retailer.
On August 30, Harley-Davidson filed a lawsuit against GearLaunch Inc. and other unnamed defendants. They’re accusing them of trademark infringement. According to Harley-Davidson, GearLaunch has been selling trademark-violating T-shirts online through several subsidiaries, as well as cybersquatting, presumably through the GearHarley.com website (where their bar-and-shield-blazoned shirts seem to be disappearing as this story is written).
The sum Harley-Davidson is seeking? They’re alleging GearLaunch sold more than 15,000 shirts infringing on the MoCo’s copyright. As a result, they’re seeking over $12 million US in statutory damages, $100,000 for each alleged case of cybersquatting, as well as other damages and lawyer costs.
Of course, the big news last month was Harley-Davidson’s $15 million hit from the EPA, so a win in this lawsuit against GearLaunch would provide some handy cash at this point, as well as putting more money from clothing sales back in Harley-Davidson’s pocket as well.
